EXPRESS ASSUMPTION OF RISK

PLEASE READ CAREFULLY BEFORE SIGNING

I, (Participant's name)................................................................understand and agree that neither Marlin 1 nor crew may be held liable in any way for any occurence inconnection with this diving program which may result in injury, or damages to me or my family.

In consideration of being allowed to undertake these dives, I HEREBY PERSONALLY ASSUME ALL RISKS in connection with the program, for any harm, damage, injury or death which may occur while I am participating in the program, including without limitation, all risks connected herewith, whether foreseen or unforeseen.

I, as a diving participant, recognize the inherent risk involved in this adventure sport activity, including the effects of environmental conditions, nitrogen, baratrauma, and marine life.

I accepy these risks as my own and it is my attention by this instrument to EXEMPT AND RELEASE MARLIN 1 AND ITS CREW from all liabilities.

I further acknowledge that having been advised of the risks associated with scuba diving, I wish to undertake an adventure dive trip with Marlin 1 and hereby release and hold harmless MARLIN 1 AND IT'S CREW from any suit, demand or claim arising as a consequence of death or injury recieved by me during my participation in said dive trip.

I further state that I am of lawful age and legally competent to sign this affirmation and release, or that I have acquired the written consent of my guardians; that I UNDERSTAND THE TERMS HEREIN ARE CONTRACTUAL and not a mere recital, and that I have signed this document of my own free will. I further acknowlege that this document may be relied upon in any proceedings instituted in any Court by me or my heirs, executors and assigns.

The information that I have provided is accurate to the best of my knowledge. I verify that I am physically fit, not under the influence of alchol or drugs at this time nor will I be at any time during the diving and I am sufficiently qualified to participate in this event
